Version 2026-10-08 · effective [[TO FILL: effective date]]
Terms of Service
The agreement between you and us when you use Tidal AI. Please read it: it explains what the service does, what you can and can't do, credits, AI output, and the limits of our responsibility.
1. Who you're agreeing with
These terms are an agreement between you and [[TO FILL: legal entity name]] (company number [[TO FILL: company number]], registered office [[TO FILL: registered address]]) ("we", "us"), which operates Tidal AI. If you use Tidal AI for an organization, you agree for that organization and confirm you are allowed to.
By accepting these terms when you first sign in, you also agree to the Acceptable Use Policy and the Tidal Credits Terms, which form part of them. Our Privacy Policy explains how we handle personal information.
2. Who can use Tidal AI
You must be 18 or older and able to form a binding contract. You may not use Tidal AI if you are in, or ordinarily resident in, a country under comprehensive UK, EU or US sanctions, or are on a sanctions list, or if the law otherwise prohibits it. Some AI models may not be available in every country.
3. What Tidal AI is
Tidal AI lets you create AI agents ("bots") that live in 3D worlds, give them tasks and multi-step jobs ("missions"), connect them to tools and services, and let them act for you: for example, research, write documents, run code in isolated machines, build and deploy apps, read and send email, and call the services you connect. Bots are powered by third-party AI models.
Features change over time. Some features are marked as previews and may change or be withdrawn.
4. Your account
Keep access to your email and sign-in providers secure: anyone who can read your sign-in emails (and so your sign-in PINs) can use your account. Tell us at [[TO FILL: security contact email]] if you think your account has been misused. You're responsible for what happens in your account and in workspaces you own, including what your bots do within the permissions you give them.
Organizations. An organization's owner controls it: who belongs, what they can do, its credits and its content. If you leave an organization, what you created there stays with it.
5. Your content, and what bots do for you
You own your content: what you upload, write or connect, and the output your bots produce for you, as far as the law allows. You give us the rights we need to host, process, transmit and display it to run the service for you (including sending it to AI models and to services you tell your bots to use). We don't use your content to train AI models.
You direct your bots. When a bot sends an email, posts a message, changes a file, runs code, deploys an app or calls a connected service, it does so on your behalf, within the tools, budgets and approval rules you set. You are responsible for those actions and for having the right to take them, including the right to email the people your bots contact and to use the accounts and data you connect. Actions we class as risky (sending messages outside your workspace, destructive changes, deploying to production, financial actions) ask for your approval by default; if you loosen that, you accept the risk.
Emails your bots send always say they were written by an AI assistant operated by your workspace, and carry an unsubscribe link. You may not remove or hide this.
Connected services. Third-party services you connect (and their terms) are your choice and responsibility. We aren't responsible for them, and they may change or stop working with Tidal AI.
6. AI output: please check it
AI output can be wrong, incomplete, out of date, biased, or not what you meant, even when it sounds confident, and even when a mission's checks pass. It is not professional advice (legal, medical, financial, tax, safety or other). Review output before relying on it, especially before it is sent to others, published, deployed or used for a decision that matters. Similar requests can produce different results. Output may resemble content created for others. See our AI transparency notice for how the AI works and its limits.
Model providers have their own usage policies, which apply to your use of their models through Tidal AI (see the Acceptable Use Policy). If you bring your own model provider key, that provider's terms apply directly between you and them.
7. Acceptable use
Follow the Acceptable Use Policy. In particular: no unlawful, harmful or abusive use; no spam or unsolicited bulk or marketing email; no attempts to break, overload or get around the service's limits or security; no attempts to get raw access to the underlying AI models or to resell them.
8. Credits and payment
Usage is paid for in Tidal Credits. What a credit is, how pricing works, expiry and refunds (including your right to cancel as a consumer in the UK or EU) are in the Tidal Credits Terms. Prices are shown before you buy. [[TO FILL: payment provider, billing entity, VAT/sales tax handling]].
9. Our service
We work to keep Tidal AI available, secure and working as described, and provide it with reasonable care and skill. We may change, suspend or stop features, and we'll give reasonable notice of changes that significantly affect you unless we need to act sooner (for security, legal or abuse reasons). Running bots, machines and apps depend on providers outside our control and may occasionally fail or be interrupted.
10. Suspension and termination
You can stop using Tidal AI and delete your account at any time from Legal & privacy.
We may suspend or restrict your account, a workspace, a bot or a feature, immediately where necessary, if we reasonably believe you have broken these terms or the Acceptable Use Policy, if your use creates a risk to others, to us or to our providers (for example, a model provider's restrictions), if required by law, or if payment fails. Where we can, we'll tell you why and give you a chance to fix the problem. If we end your account for reasons other than your breach, we will refund unused purchased credits.
11. Responsibility and liability
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.
If you are a consumer in the UK or EU: we are responsible for foreseeable loss and damage caused by our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses (you agree to use Tidal AI for personal purposes when acting as a consumer), or for loss caused by your own decisions, including acting on AI output without checking it, or the actions your bots take within the permissions you gave them.
If you use Tidal AI for business: to the extent the law allows, the service is provided "as is"; we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill; and our total liability in any 12 months is limited to [[TO FILL: liability cap, e.g. the greater of the amount you paid us in those 12 months and £100]]. You will compensate us for claims by third parties arising from your content or your bots' actions in breach of these terms [[TO FILL: confirm indemnity scope with counsel]].
12. Intellectual property
Tidal AI, its software, worlds, creatures and brand are ours or our licensors'. We give you a personal, non-exclusive, non-transferable right to use the service under these terms. Feedback you give us we may use freely.
13. Changes to these terms
We may update these terms. We'll show the new version and its date, and, for significant changes, ask you to accept them in the app before you continue. If you don't accept, you can delete your account and get a refund of unused purchased credits.
14. Law and disputes
These terms are governed by the law of [[TO FILL: governing law, e.g. England and Wales]], and the courts of [[TO FILL: jurisdiction]] have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring proceedings there. EU consumers can find information on out-of-court dispute resolution at [[TO FILL: ADR body, if any]].
